Bill 4355 Passed In Principle as to the Extension of Powers of Local Self-Government Bodies in the Field of Land Management

The Verkhovna Rada of Ukraine passed in principle Bill No. 4355 as to the Extension of Powers of Local Self-Government Bodies in the Field of Land Management and as to the Strengthening of State Control over the Use and Protection of Lands on April 19, 2016. The authors of the Bill are 37 People’s Deputies of Ukraine, the Secretariat of the Committee on Agrarian Policy and Land Relations, the State Service of Ukraine for Geodesy, Cartography and Cadastre, the Ukrainian Agrarian Association also taking part in its development.

The main provisions of the Bill include the following:

1. To provide that state-owned land outside residential areas shall be transferred to the ownership of territorial communities united under the law and determine the procedure thereof.

2. To transfer to village, town and local city councils the right to manage the state-owned lands located beyond the borders of residential areas as delegated powers (except for defense lands, lands of nature reserve funds and other nature-oriented purpose on nationwide objects of nature reserve fund and others being of importance to the state).

3. To confer powers of state control over land use and protection on:

  • the central authority implementing the state policy in the field of land relations;
  • executive authorities in village, town and city councils (in terms of control over the fulfillment of the requirements for land use according to the designated purpose; compliance with the terms of timely return of temporarily occupied land and enforcing measures to bring it to a condition suitable for its intended use; taking measures according to the legislation to return illegally occupied land to its owners or users).

To provide that executive local government bodies shall have the authority of state control over land use and protection in case the respective council takes a decision on its implementation.

To provide that the central executive authority pursuing the state policy in the field of land relations shall monitor the executive local government bodies exercising state control over land use and protection.

4. To entrust executive local government bodies with powers on the change of designated purpose of privately-owned land plots.

5. Prescribe the procedure of establishment (renewal) of territorial community boundaries in case of uncertainty or dispute thereon.

The Bill takes into account the standpoints of civil organizations, business representatives, experts and state agencies whose terms of reference relate to the issues proposed for settlement by the Bill.

It is worth noting that the Bill contains all the best practices of Bill 1159 and 3510, in the development of which the Ukrainian Agrarian Association took part. The development of the Bill took more than a year in general, and its final version became a compromise position of all parties involved.
